Returns item not arrived, where will paypal lay their favour?

I sold an item, buyer left positive feedback, all was good.
Then later was told it never worked and he wanted refund.
I said must have been damaged in the post, heres my POP(SD) make a claim. (he disposed of my packaging, grr) Wasn't good enough so he arranged to return.

Buyer now claims it was returned, Special Delivery, and has provided a tracking number, which shows it was delivered (somewhere locally, but no address for me to see) and was signed for. The Surname written by the recipient is mine, but spelt wrongly, and the signature is a squiggle, nothing like mine, looks like a childs done it.
He has now put in a claim with Paypal.

I hear that if he has a tracking number Paypal will rule in his favour, but whos to say it was THAT item in the packaging?
I want to check the documented serial number, and that its not smashed etc, purposely broken.

If its true that all is needed is a tracking number, does that not open a whole world of trouble (people sending empty boxes etc?)

Please help, as hes refusing to take this further with Royal Mail, and I can't without the proof of post.

Why did you give the buyer your POP? As the seller it's your responsibility to make the claim.

I saw the form saying either the sender, or recipient can make a claim. I was peed at not having the packaging, so told him to make the claim, thought it would be easier, and also thought he was scamming in some way, or had broken it himself (after leaving + feedback) and knew it wasnt RM's fault.
I didnt send it, as he asked to return, which I agreed to so I could examine it myself before refunding, and then making a claim myself.

Oh and i'm no powerseller, I have no idea on the Ebay etiquette. Ive sold the odd thing that I need to, and this is the first real claim I've dealt with as a seller. Its a big one too, that I really couldn't afford.

With a tracking number showing delivery the buyer will win easily. However you can appeal asking paypal or ebay to review the address shown on the special delivery receipt and if that does not match you should be able to persuade ebay/paypal to change their mind.

However the fact that originally you opted not to refund *might* just count against you so don't mention that at all if you talk to ebay/paypal. You lost the chance to check the item once you refused the original refund, now it has gone to a paypal claim there is virtually nothing at all you can do.

If he refuses to help does that not make him obstructive, preventing me from getting my money back for a missing item.
Its unfair that its my fault on either side, i send it, my fault, he sends it, my fault???!!

You will need to appeal to Paypal if they close in the other partys favour. They will then have to show the address it was sent to.
