My girlfriend was made redundant yesterday

My girlfriend was made redundant yesterday, they called all the employees into a room and told us to go home as the company was in administration. great.

Now the problem is, my girlfriend is 23 weeks pregnant, has already handed in her Matb1 form and is due on maternity leave on the first week of october-will she still get this? her "HR" rep said they are legally obliged to-but we cant risk this not being true?

also, they have said she "might get paid this months wages-dont know when" and "you will get redundancy pay-dont know when"
should she be accepting this?

    Can't help on the maternity pay front.

    Essentially, the company has gone bust. There are two options:

    1) Someone buys the company and keeps the staff on.

    2) The company is finished and wound up. In this case there probably isn't money to pay the wages owed, nor notice pay, redundancy pay, holiday pay, even any expenses outstanding. Your girlfriend will become a creditor of the company and might be paid some of the money owed in time, probably months or years away. You can claim some of the money owed from a National Insurance fund, usually the paperwork for the NI fund claims is handled by the administrator. I suspect they'll be in touch soon with the correct forms.

    To answer your question,

    HMRC will pay your girlfriend the maternity pay provided the Employer has been formally declared insolvent.

    Regards to Redundancy payment, depending on her length of employment she is entitled to her redundancy payment. If the company cannot pay it, she can apply for it to the national insurance fund department.
