No item..where's my money?

I'm not sure if someone else has posted related issue before but I really need help on this...

In January this year (I've waited for too long), I purchased an item from a private selling website overseas (ie. not ebay or amazon), and paid via credit card. They posted the parcel with a tracking number so I was able to track the item down. The item never arrived. On the tracking system, it said "item failed to deliver to recipient" then that was the end. I called post company and they held an investigation for the matter but one month later, they officially declared that the parcel was lost and said that the sender should be able to to compensate from their postal company. I contacted the seller straight away and they said they cannot refund me until the parcel has returned them. I've been waiting ever since. I've contacted them numerous times after that but they said the same thing every time! Is there something I can do? I think this is very unfair, not only did I not receive my item but have also lost my money. please help!! :(

Get onto your credit card company.

If the thing cost more that £100 then a claim under Section 75 of the Consumer Credit Act 1974 seems appropriate.

If it cost less than £100 then a claim should be made under the credit card company's chargeback scheme.

Either way, full details if both these can be found in MSE's Section 75 Refunds article.
