Esc A19 and Tax Codes

    Contrary to others experiences on her, I was in virtually the same position in April this year. IR claimed I have underpaid income tax of £2936 since 2009.

    I wrote a letter telling them that I had provided them with all information for tax assessment at the time and as I became aware of it and whilst I in no way disputed their figures, the error occurred due to their calculations.

    I did not mention A19 in the letter but I hinted at it (even though I had researched as was well aware)

    About 6 weeks later, I got a letter advising me that all outstanding tax amounts had been written off. Not only that, I had a reassessment last year and at that time, they said I had underpaid £410. I have been repaying that amount for the past 8 months, and they sent me a refund cheque for what I had been repaying and already accepted.

    So don't give up. Its worth writing a nice letter. I explained the financial hardship it would cause me by dropping my tax code from 683L to 380L, somehting again which I think their codes of practice says they shouldn't have done due to the amount.

    Thankyou for your reply it's really nice to have some encouraging news I'm so glad you managed to get it all sorted out, I have wrote to them at the end of May I am still waiting to hear from them I will post when I get a response.

    I got a no for the ESC A19 last week their reason behind this is because they cannot find no record of us contacting them, I have put a timeline together with names of people I spoke to and dates and sent this with the appeal letter back. Is it normal for them to come back with this answer? Can anybody give me any advice please.

    ESCA19 will not apply in this case due to the time scales and the fact you complete a tax return.

    but why were you asked to complete a tax return ?

    being higher rate, and having 3 jobs doesn't mean a tax return there must be some other reason. If the part time jobs were the only reason for the underpayment then earnings would have been about 17,000 in 9-10 and 15000 in 10/11, does that sound about right ?

    dori2o can most likely confirm the dates, but weren't HMRC's new MPPC paye computers installed in June 2009 and there was a month of no system access, so no codes were being issued in june or early july 09

    Thank you for your help, I don't no why we were asked to complete a tax return we just had a request arrive in the post. In 9-10 my husbands earnings were around £60,000 and 10/11 it was £66,000. He earns £45,000 for main job and the tax codings are fine for that, the rest comes from his part-time work which he started in 09 and that is where all our problems began.
