Estate Agents have withdrawn our property from the market without consulting us

    This is the first time we have heard from them in months!
    I haven't been in touch with them for some time admittedly but I was beginning to get fed up of them never responding to my calls.
    We have acted upon their instructions regarding price and on the last revised listing we agreed to POA.
    I have checked Rightmove today only to find the property has been removed!
    I really don't see how this can be legit.

    Isn't it common to get rid of sellers who over value their properties and refuse to drop the price over the long term.

    With most failures to sell it is all down to wrong price especially if you have had no viewings. Shame it took 2 years to realise. If you priced right last year you would have had a good chance of selling, now prices have fallen from then and are set to continue falling. Buyers are now waiting out.

    Check you contract for hip fees and if you really want to sell price right with a new agent.

    Sounds to me like they've sent out a stock letter and not bothered changing the details. Very shoddy behaviour on their part. Probably not illegal though.
    Frankly though, if you've not heard from them in months and haven't been getting any viewings, you don't sound like a very motivated seller. You should have found out why long long ago.

    I think the fact that you only had one viewing in two years and haven't been chasing up the EA significantly and your house is marketed as POA means you weren't incredibly serious about selling it anyway.

    Just pay for the work done on the HIP and forget about it.

    Is it possible that another of their customers (with same surname as you, or similar address) has had correspondence with the EA to terminate, and due to someone picking up the wrong file, opening wrong folder, whatever, they've accidentally sent you a letter that was intended for someone else?

    Whatever may have happened, wouldn't you be better off merely speaking to your agent, rather than posting here?

    Sounds to me that you have reached an impasse. You won't reduce the price, they know it won't fetch that money, so its end game.

    the relationship between you and your agent will be defined in the contract. If they can terminate it and charge you for the HIP then that's precisely what they will do.

    Strange that you say you have been so flexible on price and yet they haven't even begun to sell your property. I don't have any specific reason to disbelieve your account but in a way none of that really matters. Read your contract to see if you are liable to pay the HIP bill. No-one here can tell you any more.

    It seems if you complain to Connells, they will simply issue the missing letter giving you the required notice. You'll then be back to this point in a month or two, depending on the terms of your contract.

    I assume the terms of cancellation are the same on both sides, so they are doing to you exactly what you could have done to them. Two years is a long time to stay with an agent in whom you have no confidence.

    Reading between the lines, I expect your problem is more to do with paying for something you now view as obsolete and worthless and you're trying to find an angle which would allow you to avoid payment?

    I can't see any reason why you shouldn't pay for the HIP and getting it over with and moving on may be your best option.
