On ESA had my atos examination today

    I had a atos examination, It worked on a point basis. When the results came back I had scored nothing! I had letters of my psychiatrist, copies of doctors notes and i explained to him how I had to gave up my career due to mental ilness. I appealed the decision. Still nothing. So after I was kicked off ESA my psychiatrist advised I reapply for ESA stright away and when I have a new atos, I should take my husband to explane things (I don't know if my psychiatrist knew something I didn't) but I passed the atos, I don't know by how many point because they just said I passed.

    What I my saying is don't give up, If you don't pass, appeal, and you can always reapply.

    Due to the high number of successful appeals, and the input of Prof Harrington/the various committees in parliament, ATOS and the DWP are generally taking much more account of any medical evidence now than they were before.:T

    It sounds as though it's all fine and they'll probably award you ESA, with a date for review.

    If they don't, definately appeal though.

    Justice at last eh. Would definitely consider requesting a copy of the ATOS medical report for your future information.

    It varies, it usually takes between a few days and a few weeks to hear but it has been known to take longer.

    It can take weeks... and they can be poor at informing of outcome. I would advise, as always, to request a copy of the ATOS medical report from the DWP which will probably give you a good idea as to what to expect. There's nothing to lose from doing so apart from the cost of the call and it can save a lot of anxiety... or if worst happens, save you time in plotting appeal. In the meantime watch your account for any change to the ESA payments.

  • I have also found out that if your ESA is stopped they inform housing benefit and that gets stopped to.

    Well things like your housing benefit/council tax benefit are probably qualified for by your entitlement to ESA so if they don't inform them (council) then you'd have to.

    But I'd try not to let your thoughts race ahead of you. It hasn't come to that.

    It is ridiculous that HB is stopped if the entitlement to ESA is stopped based on failing the medical/ appeal / tribunal because you obviously have no income or would not apply for ESA! Now if ESA is stopped because of income related issues, (such as you are earning money and not entitled) then I understand it.

    This stopping H B is costing money and causing people unecessary stress because it is taking weeks to get it back due to the backlog of claims and reclaims, and some Landlords will not wait weeks, so it can potentially lead to homelessness (if it hasn't already)

    What they should do is determine if HB is needed - for example, in the case of migrations of someone who has been getting HB on income support, if they fail their medical then they will be entitled to JSA if they don't appeal, which entitles you to HB, so they should have a temporary period once ESA is stopped to keep HB payments as they are while reviewing the claimant's income.

    I feel so very strongly about this issue as I see the stress caused by having to wait months for it to be reinstated. Additionally, they also take your DLA off you if they stop your ESA.

    This isn't necessarily true. ESA is an out of work benefit paid if you are considered unfit for work. DLA is not an out of work benefit as you can receive it whether you're working or not. Therefore not being entitled to ESA does not mean you are not entitled to DLA. Many people receive DLA who are not entitled to ESA.
