Can they kick me out

Without sounding like a welfare case, I have suddenly found myself in this predicament:

Just recieved a letter from DE saying that I have to vacate within 4 weeks??
Apparently Due to being posted to a specialist unit in Dec I lost my entitlement to stay at my current location. Ok fair one but I have a few points.

1. Can they just kick me out like that with no warnings etc?
2. My wife cant move due to having a good job so financially it makes sense for me to give up my Job. She would also have to give 4 weeks notice as well!
3. We are currently in the process of buying a house, it has taken some time due to one house sale falling through but this ones looking quite promising. But what if this falls through can I stay longer untill I finally get a house sorted?
4. If I have to rent privately will the MOD give any allowances to cope with the drastic rent increase?
5. We are currently undergoing IVF I heard that we would be entitled to stay for a bit longer, is this true!
6. I'm in the bracket for redundancy in September!!!

I did ring the Telford office who basically said it was my responsibility to sort out accommodation in my new area however this doesn't solve the fact that my wife cant move.
Also there is a lot of empty houses on my estate so I cant see the urgency.

Technically I can be homeless in 4 weeks and jobless in 3 months? Unless my wife gives up her job of which we could then both find ourselves unemployed in Sept!

What I want to know is where do I stand??? I understand that DE want houses but for them to be so pushy and demanding given my uncertainty for my future career seems pretty harsh??

Anyone been in a similar situation or got any advice!!!

  • Is there any reason why you didnt apply for mq's at your new post seeing that you would be there for at least 6 months? and have you spoken to your local welfare office to see if theres anything they can do to help you?

    yeah my original plan was to move me and my wife to my new place but after a lot of research and a look at the place there was no suitable jobs available and the area is quite poor, put this in with the fact that Im away a hell of a lot with my new job means my wife would be alone with no real prospects, then she went and got a promotion at work which changed things financially!
    however the new plan was to remain in my current MQ and buy our own house, this has turned out to be quite a lengthy process with numerous challenges on the way.
    hopefully touch wood Ill be ok and we will get in our own home soon, however what if this happens to a young private soldier or someone without savings and a plan??????

    I find the whole situation Bizzare, and appalled that the housing people have the right to do it!

    Surley some sort of warning system would go a long way not just a letter through the post saying to be out in 4 weeks!

    Oh and its a different story when you need stuff repairing or replacing, they dont rush to do that do they?? (that however is another topic)

    As for my local welfare, I want to get my facts straight first and know where I stand as I imagine they will just say its all in the relevent JSP etc etc! and theres not a lot they can do (its probally them that raised the issue to be fair)??

    I just find this an amazing situation to be in? After many years of selfess dedication to the Army, does it not deserve to be returned? or at least compromised in some way?

    2. My wife cant move due to having a good job so financially it makes sense for me to give up my Job. She would also have to give 4 weeks notice as well! And? The MQ are a perk of your job, NOT your partners
    3. We are currently in the process of buying a house, it has taken some time due to one house sale falling through but this ones looking quite promising. But what if this falls through can I stay longer until I finally get a house sorted? They should let you stay a few months extra if you are moving into to private accom but dependent on status and MQ requirements in your area

    Its in the contratc you signed when you took over your MQ - why should you be any different?

    As above, unless you are with 50 miles of your new place of work from your current MQ, you'll have to rent or buy privately (or if you have kids in GCSE/A level stages).

    I know I sound harsh but this, ultimately, is what your rental agreement with DHE is.

    You have to remember you joined the forces and all the 'perks' (or whats left of them) are for your benefit with your job and not your family.
    30th June 2021 completely debt free…. Downsized, reduced working hours and living the dream.

    Did you ask permission to retain the qtr you are currently in?

    If not that may possibly be why this is happening.

    not jobless of my own accord though? surely it makes sense to aim off that one of us remains employed?? however if i choose to remain housed then that could make us both unemployed in sept!

    Its in the contratc you signed when you took over your MQ - why should you be any different?


    When i signed the contract i wasnt made aware i could be made redundant two years later! (did anyone???)

    Why don't you contact SSAFA (Forcesline) 0800 731 4880 they might be able to help you put a case together for keeping your MQ.
    You cant take the trousers off an elephant!
  • Have you spoken to welfare yet?

    We had a letter from welfare for our last qtr giving us an extension of 8 months and it was accepted even tho they had people down to march in the following week (their !!!! up)

    If your no longer posted there then why would you expect to stay in the qtr? If your wife is happy with her job then like you said go down the private rent route untill your house is sorted. This would be your own choice so you wouldnt be entitled to any help from the mod.

    I suggest getting onto welfare and see if there is any chance of getting an extension other than that DE and MOD have no reason to help you out. You could get a qtr at your new posting as you have chosen not to the rest is up to you.

    cant comment on home situation but hubby and I currently undergoing assissted fertility and he has been told that he can have time off for all hospital appointments, hope that helps.(also know of female forces having roles change so can continue with treatment etc I would ring welfare to see if would add to you cause)

    IIRC its in reality 9 months before they can 'kick' you out. But if you are no longer an MOD employee you have to pay full rent. The first 3 months is to apply to extend, the next 3 months on full rent and last 3 months as notice. (no facts here just hear say)

    If you are no longer going to be employed then apply for local housing(you do have priority), then your wife doesn't have to quit etc.

    Eventually this will and does happen to all MOD employees, I am genuinely sorry to hear you have been put on redundancy but there is a pay out as far as i know and tbh you should make the most of any learning credits/ resettlement and get all the quals you can to transfer to civvi street. You have at least 3 months to make the most of the benefits you have. Oh and go get a full medical, all dentistry done and anything else because otherwise you'll be in for a shock when thats gone too.

    It's 12 months notice for non-volunteers made redundant, so you're assured employment until at least 31 Aug 12 if you didn't volunteer for redundancy. Hope that's reassuring.

    You're entitled to SFA where you're posted unless kids are due exams at school. IVF treatment is worth a welfare call, as others have said. All too often spouses and partners have to give up careers if they want to live with their serving husband/wife. It's just a fact of Service life.
