Not allowed to redownload paid for Wii game

Hi all,
I have a Nintendo Wii and it was over a year old when it developed a fault, upon checking the built in diary I found out that I had only had 118 hours gameplay out of it over 15 month's. When I e-mailed Nintendo they said post it back to them and they will fix the fault for £65 and give me a years warranty on the fault. I rang the shop I got it from (Gamestation) and the acting manager said " bring in the console and I will exchange it as it has hardly been used" he also asked if I wanted to pay £29 and I could have a 2 yr warranty on the new console, this I did.
My main problem was that on my returned console I had 8 games that I had paid for and downloaded onto the Wii, and I did expect that when I got my new console home I could (like my son on his X Box and my pal on his PS3) re-download the games. Nintendo said NO I am not allowed to I have to re-pay for them, and also the shop should have told me this and asked if I had an games and they should have transferred them over. I rang the shop and was told this was just Nintendo passing the buck.
Is there anything I can do as I dont think I should have to re-pay over £50 for games that I had already paid for, and it seem's petty when you can redownload them for xbox and ps3's. It's not as if I am loading 5 or 6 copies as you can only do it to a designated consloe name and number (so they can keep a check on it). Sorry it's long winded but wanted to give you the full picture.
