Virgin Mobile - Change in T & Cs - Can I cancel

Hi Everyone,
It appears Virgin Mobile are increasing their tariffs (I think particularly texts and internetwork calls)
I don't go over my allowance, but I don't particularly like that they changed the costs mere months after I signed up.
Is it legitimate grounds to cancel.

10.2 Your right to cancel: You may end this Agreement immediately in the following circumstances:
(a) if we break this Agreement in any material way and do not put it right within seven days of you asking us to;
(b) if all of the Services are permanently no longer available to you;
(c) if you do not accept any change that we notify you about in accordance with clause 5.3 and you notify us in accordance with clause 5.4 that you do not accept such change.
5.3 Significant changes: We will notify you at least one month in advance of any change coming into effect that (in our reasonable opinion):
(a) will increase the monthly or other periodic Charges for your Contract Allowance by an amount which is more than the percentage increase in the previous twelve month period in the Retail Prices Index (or any future equivalent) published by the Office for National Statistics; or
(b) is a change to your Agreement, your Contract Allowance, the Services or any Additional Services you are using, or to the Charges for any Services or Additional Services you are using, which is likely to be of material detriment to you.
5.4 Non acceptance of changes: If you do not accept a change that falls within clause 5.3 you may cancel this Agreement by writing to us within 1 month of us telling you about any change, to let us know that you want to cancel. However you may not cancel this Agreement if such change:
(a) has been imposed on us by any regulator with appropriate authority, for example OFCOM, or as a direct result of new legislation, statutory instrument or government regulation; or
(b) relates solely to an Additional Service. If this is the case then you may cancel such Additional Service by giving us a least ten days notice in writing to that effect.0 -
Sorry to be thick but I am a year into a 2 year contract got a free blackberry phone and am on £15 a month tariff. Its my sons phone and he always goes over his allowance much to my annoyance. The lowest limit they will set is £50 and he has even gone over this and they let it. The customer service is appalling and cant wait to change does anyone know if I am in my rights to cancel due to these new terms.0

Most networks will not set any limit, so you can only really control it with PAYG.
Can you cancel? See abomb's post. But you can only really claim to cancel if you use the services that are being increased, so do you use any of the services that they are increasing ? If "No", then you can't demonstrate any detriment to you.0 -

Then I would email them, informing them that, in your opinion, Virgin have altered the terms of the contract to your detriment - quote what the difference would have been on the last bill if the new rates were in force - and say that you wish to invoke their t&c quoted in 5.4 of abomb's post above.
Then wait, but do not cancel DD until you get the ok. I am not sure, however, what happens to the mobile number in such a case.
