    May well be that the data was present, but the lender was not overly concerned about it if it was 4-5 years old, or more likely that it wasn’t there full stop.

    I think the first thing to determine before any contact is made with the DCA is exactly when the last acknowledgment / payment was.

    if you are unable to accurately or confidently determine this then come back and we can suggest the next move.

    Try not to let it worry you too much, it's been there for possibly over 6 years, a few more weeks over the festive period is of little consequence!

    bad luck always happens in 3's right?

    well this is hopefully my 3rd! shan't go into detail but they involve cars, clutch + flywheel and british gas... ugh!

  • Another way of looking at it is this:-

    If it's an old credit card debt and the clock is still ticking on the statute of limitations (6 year rule) then you have every right to claim any charges to reduce that debt. Why not write to the debt collector with the letter asking them to prove the debt then they will be able to clarify it.

    I had an old credit card that defaulted (I have paid it off) but the balance was £650 of which £200 was actual credit I had taken out, the rest was charges. Well worth challenging in my opinion if you are going to do the honest thing and try and pay it.

    If you're stuck for the letter I'm sure someone here can oblige, I'm only on here every now and then now.

    It would be interesting to know just how much is the actual 'debt' and how much has been added on as 'charges', which may be unlawful and could be claimed back.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

  • I would question your ethics.

    Taking someones or an organisations money, than forgetting you took the money (how fortunate you forgot) and now that you have been caught you giving the impression you are the victim.

    If you owe the money than make arrangements to pay it (one off payment or by installments), I cannot see what your problem is other than the debt has caught up with you and you have some explaining to do to your spouse.

    Sorry to sound harsh but thats how I see it.

    Ha! I do know what you're saying but i did actually forget about the debt, i was at that time in a very bad relationship, got a credit card, maxed it out (retail therapy) moved out of my ex's house with nothing but the clothes on mine and my 2 kiddies backs and started our lives again!

    so yes i put everything behind me and forgot about my credit card...

    I am also a very honest person and if i do have to pay the debt then i will, but if there is some loophole that i can take advantage of then why the hell wouldn't i? this is why i am on here, to find out my rights! i'm sure there is a lot of legal information surrounding debt etc that the fatcats don't divulge to the rest of us! isn't that one reason why we are all here on this website?

    anyway, rant over.....

    (oh and i just got my experian credit report back and its not mentioned on there at all.... will it be on equifax then? thats the general rule isnt it? if not on experian will be on equifax and vice verca?)

    How can you on one hand be a "very honest person" and on the other hand look for loopholes so you do not have to take responsibilities for your actions or in this case debt you agree to having but feel reluctant to pay for no other reason than you forgot about it?
