Old CC debt!

Hi Everyone!

Argh! i have just received a letter from a debt collecting agency saying i owe £839.09 on an old credit card that i had completely forgotten about! Help!

I really don't know what to do!

The credit card debt is about 5 or 6 years old.

The letter came in my maiden name, to my new address (bought house 9 months ago) and i'm just a bit confused as to why they are trying to collect now, when i was applying for a mortgage last year with my husband i had to give my maiden name and old addresses etc...

i really don't know what to do for the best... do i call them or what? argh!

can someone please give me some advice?

    It matters whether the debt is more than 6 years old; if it is less than six years old then it isn't statute barred and you are liable. If you do owe the money you might feel a moral obligation to pay it back anyway; presumably you enjoyed spending it at the time.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    MORAL THIS MORAL THAT BANKS HAVE PROVED THEY HAVE NO MORALS ETC JUST IGNORE IF THEY WANT LET THEM TAKE YOU TO COURT FOR IT ,WHEN I WAS IN DEBT I OWED 36K PAID THE LOT OFF OVER 4 YEARS 7K OF THAT WAS MADE UP OF LATE PAYMENT CHARGES, LETTERS,ECT I HAVE NOT INCLUDED INTEREST AS I WAS HAPPY TO PAY THAT, YOU HAVE NO MORAL OBLIGATION TO DCA WHO HAVE BOUGHT DEBTS ETC THERE JUST TWO BIT CARPET BAGGERS IF THEY WERE NOT DOING THAT FOR A LIVING THEY WOULD BE DOING SOMETHING DISHONEST TO MAKE A FEW QUID

    Yeah. They would probably be borrowing money on a card and not paying it back ...

    First things first, you need to find out the exact date of last contact/payment about the debt. If it is over 6 years it is statute barred, if not you're still liable I'm afraid.

    Even if it is barred, binning it will not help. You need to inform them of this if you want to keep your credit rating intact.

    Ignoring this isn't going to make it go away, no matter how moral or immoral banks and DCAs may be....

    The ”person” named will not be on the electoral roll, however the overriding point here is that the DCA have obviously traced the individual from an alias link after an application was made for credit elsewhere, and the maiden and married names were ”linked” on the credit application and then file

    Therefore the fact that the agreement was taken out in the maiden name is of little relevance.

    Points to resolve;

    1) Confirm exact date of last payment or acknowledgement of debt. If it is in excess of 6 years then aside from the moral issue then the creditor is deemed by law to of had sufficient time to trace you and enforce payment
    2) Do not ignore or bin the letter, most DCA’s are less than reputable, and if they have found your married name from a link on your credit file they will more than likely now enter a default notice onto your credit file (whether it is justified / lawful or not)
    3) Get a copy of your credit file ASAP to see if (2) has already occurred.
    4) If the debt is indeed over 6 years old, or the DCA is unable to document either the debt, or their right to receive payment then you should formally instruct them then no further contact should be made, and that if an entry has been made to your credit file that it is removed forthwith as unsubstantiated

    This is what i can't get my head around. Me and my husband applied for a mortgage last year and i had given all my details - maiden name, old addresses etc.... surely i should not have been able to get a mortgage?! so i'm wondering why it didn't show up then, only now a year later... if i have to pay it then i guess i will have to add it to my other debts....but it's just annoying me as its been such a long time and i've not even thought about it for years and years.... even before i met my husband!

    and getting the letter less than a week before christmas... thats just cruel!

    I'm a newbie on here and this was my first post...thanks for all your replies....i have registered on experian for the 30 day trial... so i'll see what that brings up...

    i intend after christmas to sort my debts out... so i'm sure i'll be posting lots more questions on here!
