Some advice please!!!!

Sorry I am new to this and am so happy to have stumbled across this site!
My husband has a well paid job however, there was a disagreement with the INland Revenue and imposed a CCJ on a sum of money that we are about to clear.
My problem is the bank. As soon as the ccj was known about they withdrew overdraught. Fine, we dealt with that. There are no creditors etc just the inland rev. We owe a loan of £6,000 (payments always paid) and £4,000 credit card (again always paid) so as far as debts are concerned we are doing ok.
However, my husbands income was lower than normal (it fluctuates!) and we asked under these special circumstances would they allow us an overdraft facility.
Well today i spoke to our personal manager who informed me that the lending department decided against an overdraft because there are payments made that arent necessary and if we stopped them, we wouldnt need an overdraft.
The unnecessary payments are my 3 sons school fees. Now I know private education is a contentious issue, and neither my husband nor myself attended a private school and many of you may agree with the bank, but at the moment two of my sons are taking GCSE's and the youngest is just starting his!! a crucial time. I have been in touch with local grammar schools and there are no places available.
My query is can they refuse on these grounds, I am unsure, fortunately we have survived the month as i robbed my bank acct before some payments could be taken incurring more charges and damaging my credit rating. The annoying thing is that a facility of £1k would have avoided all this. My personal manager then pointed out that I couldnt leave as we now have unpaid items on our bank statements. I pointed out there wouldnt be if they had allowed us the overdraft!
I know im not in a bad situation but i need some advice as i am furious with RBS.

They are load / overdraft to who they like, under what ever terms they like.
You seem to owe £10K if I understand all this correctly, although paid, what are the interest rates on thse? so I would suggest even with your husbands well paid job, you have some issues / problems.

Yes, easily said, there is more background to the IR and actually we paid what we were told at the time, however thats another story! The CCJ is a seperate matter and paying the school fees have always been met. It was only this month I sought an overdraft.
I only came on for advice, I just wondered if there were guidelines for banks but I have discovered that there aren't!
