Having thought it through for your case. Do not send that letter just stand your ground if they visit in the coming months. But least you can use the info in the letter to refer to your rights etc.
Here to learn and pass on my experiences.
Had a total of £8200 of debt written off due to harassment during 2010 and 2012.
  • Thanks guys, i will hold back for a couple more months then send that letter.

Im grateful for all you replies

    Thank you
  • My mum had a debt a long time ago and some company offered her some deal to get it paid off! but she was being contacted by 3 different agencies.
So she paid it off to this one company and then she contacted the other two to say stop harrassing her. The other one seemed fine about it, just to send a letter and she has had no problem. However the other company was scotcall!
They told her she'd paid the wrong company and had to pay them or else!
They turned up today on our doorstep out of the blue asking when she would be home and when they could contact her so i just stayed really vague and gave the number they already had for her which she'd been contacting them on! and he left a card saying it was important this was the first visit and that they would be back basically!
Now i know they cant get away with it as they're breaking so many laws but i need some help! Pleaseeeee

Your best course of action at this stage is the head in the sand and wait for it to go away approach.

But just for your own reference if you are using Statue Barred debt as your defence, you must do the following

You have not made any payments on the debt over the last 6 years AND

The creditor has not taken court action against you, eg CCJ, AND

During the years, you haven't written to the creditor acknowledging that owe them money.

Writing to them to tell them to sod off doesn't count.

Your best way to check if it has become statue barred, is to get a copy of your credit file. If the debit is not on there, it is more than likey 6 years have passed since the date of the default and it has came off your file, so therefore is unenforceable.

If it is on there , you will be able to see the date that it drops off, and know when you are out of the woods.
  • I have just had scotcall text me saying I have failed contacted them. And that I should call immediately blah blah blah.
This has most likely been passed on by the lovely CCS who have been pestering me for months via text and phone calls about some debt I have no awareness of.
According to CCS I owe money to BT. I used to have a BT account 4 years ago when I lived with my ex wife. I believe she has been using that old account in my name without my knowledge, that account is even registered at her current address. I have had no written communication with either company and I even have a new BT account that I set up with trouble.

If I have no knowledge of this debt (I don't even know the account number etc) can I be liable even if it is my name (unknowingly)?

    Any help gratefully received :)

If that's true, I'd say she's guilty of Identity Theft.

Do you have debts which may have been passed to them?

    If not, just ignore it.

If anyone asks you to confirm your name or asks for you by name, it is usually trouble.
A bit of quick thinking soon sends them packing, as them to confirm who they are first, they usually !!!!!! off with empty threats if you start asking the questions .
    Be happy...;)
