thank you so much, i spoke to a solicitor and she said that they shouldn't be interested in my outgoings, all they want to see is how much money is coming into my account, as you can pay childcare fees by cash so theres no way of knowing what the withdrawels were for. Im going to get my childminder to write me a letter stating fees paid etc and see what happens, im quite a bit behind and they will notice no payments have been made if they go through my bank accounts.

This would be the most sensible thing to do. Get an up-to-date statement showing bills and monies paid so far.
  • Is there anyway they could see the weeks I havn't paid my childminder and say for that week they overpaid me housing benefit? Thats what im worried about, that their going to tick all the weeks I havn't paid my childminder and say 'well that week you had the money to pay full rent because you failed to pay your childcare', could they do this??

I too am very sorry to hear about the death of your husband and can understand how difficult things are for you. Im sorry if it comes across that I judge you as I commented on the OP. Im really pleased that you have an understanding childminder - i know when I used childminders their attitude and care made it possible for me to carry on in difficult times. However my point still stands that she needs paying in full and on time just like you would expect to be paid as it may cause her financial hardship and eventually sour your relationship which would be a great pity for your children as she sounds like does have that heart of gold.
I must not fear. Fear is the mind-killer.
Fear is the little-death that brings total obliteration.
I will face my fear. I will permit it to pass over and through me. When it has gone past I will turn the inner eye to see its path.
When the fear has gone there will be nothing. Only I will remain.
