Another sofa screw up

Sorry, another sofa question...:(

We ordered a sofa & table on 16 January 2011 from Reids Furniture (shop, not the same as online), with estimated delivery date of 12-14 weeks, which takes us to sofa due by 24 April 2011.

We were advised our order (sofa &table) would be delayed until 20 May..and since then we haven't heard a peep from Reids. We chased regularly up to May 15th..we haven't contacted them since then.

Our contract "Terms of Sale" state "...If RF cannot deliver within two months after the quoted date for the foregoing reasons, either RF or the customer shall, without any liability to the other, be entitled to cancel the order"

So, 2 months will have expired on 24 June 2011, so Im pretty sure we can cancel now (and get back our £350 deposit), but for the following:

1. On the order form we signed in the "Manufacturers Instruction" box, the sales assistant wrote in big scrawly writing, "No cancellations"... When I queried this at the time of signing she said that it meant that we wouldn't get our deposit back if we cancelled. (but which term prevails?)

2. Also, I went in to Reids separately to enter a credit agreement and change delivery address. I was issued with an Amendment Contract (which I signed) in which estimated delivery says "April".. so should I wait to end of June?

4. Why do we want to cancel? - totally disgusted with several aspects of Reids service over past 6 months and now hate the thought of paying them for 4 years!

    Reids sell over priced crap. Ordered a suite a number of years ago in shop about 3k with a 12 week delivery date. 12 weeks went by and I popped into showroom on the saturday, to ask when I could expect the suite..no idea was the reply..we can't access that info. I asked to speak to the Manager and was told Reids don't have Managers...I left fuming!

    Monday morning I got a letter telling me the suite was getting delivered on thursday...why couldn't the showroom staff tell me that two days earlier?

    Suite was lovely on delivery....5 years later I paid to get the Council to recycle it as it was falling apart.

    Have had an Argos suite since that was more durable and it was a quarter of the price.

    Hillington by any chance?

    Yes Hillington, and I've experienced all the same useless service that you did + they told me they would reduce my delivery cost from £120 to £59.. turns out £59 is their standard UK wide delivery price!!

    So they wrote to you confirming delivery instead of calling you? I have a terrible fear they've written to me at my old address (which I went into the store and corrected). I guess that would still be their fault though.

    Anyone else have any idea which contract term prevails out of "No Cancellation" and their standard terms of use?
