Hi there -
Can someone tell me please how long it usually takes to make an appointment with the OR to hand in the petition of BR?
We are sending off "stalling" letters to our creditors this week to buy some time to fill out forms and get money together but before we approach the OR just wondered how long we may have to wait?

Hi there, if you're in England or Wales you need to find out which Court to petition your BR at. Then give them a ring to find out what their particular procedure is, whether they do a 'drop in on the day' service or appointments.
If you're in Scotland and going down the LILA route it's different.
If you can confirm which country you live in then you'll get more specific advice.When I joined, I needed a name. The forum members gave one to me...I am INAN

You don`t hand the papers to the OR. If you are in England or Wales you have to petition your BR at your local court that deals with BR. Some courts have an appointment system whilst others have a drop in system. You would have to ring your local court to find out what system they operate.

Oh I see, thank you, living in England is the answer.
So the prodedure is to go to the court first with the petition and the money then I guess they will guide us from there?
Everyone on here seem so give such good advice so if I may another queston....
what is the best way to deal with the creditors in between getting to the court - will letters stall them or just get them highly suspicious!0 -

Have you taken professional advice regarding bankruptcy? You need to be fully informed about all the pros and cons before you go anywhere near the court

Thanks Penelope - Yes we have been given lots of advice from CCCS and also IVA options (not sustainable for us!)
I have just spoken with our local court - SO SO SO helpful! What a nice man! We can make an appointment anytime within a week.
Thanks for your help again ... hopefully there is a light at the end of the tunnel ....)

In relation to your question about creditors, I'm a bit further down the line, got my court appointment next week.
I've not paid any creditors since Jan, I took advice from here and simply ignored them. Having been able to at least meet minimum payments before I did feel very bad doing it, but I believe that sometimes being in contact to offer token payments can actually initiate them chasing you more.
I have just recently received my properly scary letter from one of the credit card companies with court action on it!

We have also never missed a payment and always just about managed to squeeze the minimum payment but we are now going to just let it roll and hope we get to the Courts in the next couple of weeks or so, before they get to us!
Have you been advised to ignore that letter too - the one where they are threatening legal action?

if you think you can do the br shortly then yeah just ignore them.
my debts are 2 years old, some ive paid token payments up till last wk. i rang court and they wanted to give me the next day!

Even though it's not me who is actually going bankrupt (it is DH) I do feel I also need the support as I am the one who is doing all the organising and running around asking questions etc.!
He would actually like me to go in to court on his behalf if I could!
I don't supose I would be allowed to, does anyone know?
Or at least be with him at the OR interview?
I just know he will be an emotional wreck ....0 -
DT, he needs to go to court himself I am afraid but you can go with him and support him, that will not be a problem.
