Fraudulent transaction

I decided to check my online banking out of the blue this morning and to my horror I noticed a transaction on my account which I did not recongise, it was an internet transaction to apple store for £522, on the 7th of June (had to be on my birthday :mad:) I rang barclays and they are going to send out some forms which I have to fill in. In the meantime they have credited the amount back into my account until it get's resolved.

Now the thing that bugs me is that when I was on the phone to Barclays they asked me If i left my card anywhere unattended I replied yes which was back in mid may, I left my card at my local wickes by accident I only realised the next day that my card was missing so when I went back to Wickes the next day it was handed in. After getting my card back I phoned barclays to explain what happened and to make sure that no unauthorised transaction was made on the day. They said no so all fine there.

My worry is that they won't refund me the money because I was not careful with my card, can they do this? When I Informed the bank about me leaving my card behind they should of pulled rank and cancelled my card straight away and sent out a new one but they chose not too. I'm guessing it's a Wickes employee who noted down my details because I left my card in the pin reader :mad:.

    Remember - you are liable for any transactions made until you have reported a card lost/stolen.

    You will just have to hope they have no notes of this on your account or can hear the telephone conversation recording.

    The OP did call Barclays when they got the card back (they say so in the original post).

    I think you've covered your back by doing that, so you should be fine. Have to wait and see though, I'm afraid.

    You are liable for any transactions made up to the point you contact your bank to report the card lost/stolen and the message stated:

    So, if the transaction was made while the cards was in the hands of Wickes then the op would be liable for the transaction in full because the card was not reported as lost or stolen at the time.

    It's up to Barclays now if they have notes to what the op said to them on the phone, if it was noted then Barclays do have the full right to say the op was negligent by not reporting the card and can say they will have to just take it on the chin. If they don't have notes and only just put it was lost/stolen then there is a very good chance you will get the money back in this case - but you will be very lucky on this one.

    In future though, as soon as you know the card is lost/stolen you get straight onto the phone to the bank and report it. Even if you know where it is, you don't pick it up the next day and then report it to the bank - You don't konw what happend in this short space of time.

    If someone had bought things online with the card details while the card was lost and the bank hadn't been informed, that would be one thing, but a significant period of time had elapsed. The card was missing for 24 hours or so in May, and was subsequently recovered. The OP reported this to his bank, in May. The fraudulent transaction was weeks later, in June. If the bank was made aware of the card's loss and subsequent recovery, they could have issued the OP with a new card to avoid something like this happening. I'm not saying that this makes the bank liable under the rules they operate, but it would seem reasonable to me.

    Thanks for the reply guys, just un update I phoned apple and they did confirm an iphone 4 was bought using my card however it got sent back to apple. they said a refund is on its way to my account which takes a few days. They also gave me a name of the person who bought the phone.

    I've phoned the bank and updated them with my findings lol.

    That puts my mind at ease.

    Do you think I should report it to the police?

    I doubt the police will be interested. Nobody has lost money, whilst an attempted crime has been committed they don't usually bother with card offences unless the bank concerned reports it.
