Alliance & Leicester reclaim overdraft charges

Some years ago I sent details to A&L re my overdraft charges following the moneysavingexpert instructions on how to do it. I eventually got a letter back saying they weren't paying out. at the time.
Does anyone know if they've ever paid out to anyone and whether it's worth trying again? They are now part of Santander.

They haven't been paying out since the court ruling unless it's under financial hardship criteria.0
