Rights for replacement items

Hypothetical this question is, but just weighing up my options for my Iphone 4 warranty.
The situation is this, 2 months ago i had my Iphone 4 replaced by Apple, for a brand new (non refurbished) phone, i know there policy is that any replacement phone only gets a warranty for the same amount that was left on the phone you are getting changed, in my case it runs out on 24th June this year.
But knowing for a fact that the replacement i got was brand new and this has been confirmed by apple themselves would it be possible to argue with them if it did go wrong after my warranty runs out or would i be better off getting their applecare?

The warranty only covers the initial purchase. Any replacements will be covered under the same warranty. Otherwise you could, in theory, change the phone for a brand new one every 23.9 months...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Yeah i suppose so, but i was hope that cause it was actually brand new it might carry more weight in an argument, usually Apple only replace it with refurbished phones but they were all out of them when i went in.
Never mind £61 for an additional year isn't to bad:beer:0
