When should I hand in my notice?

Afternoon Guys,
I have a question that isn't quite as straight forward as I would have liked, so here are some facts about the situation ~
I would like to hand in my notice 2 weeks into the 6 week summer holidays, in order to give 4 weeks notice and therefor be paid up to the end of August.
I am concerned that it is "illegal"?? to still work for the school as I wont have handed in my notice, but have started work for the new company. The new job states that they would like someone to start ASAP, so I don't think they would want me to wait to hand in my notice.
I'll stop there as it's alot to take in but can clarify any points if anyone is kind enough to reply.

- I currently work in a High School as support staff
- I work Term time only (39 weeks per year)
- I started in September 2008
- I get paid my 44 weeks wages in equal parts over 12 months (44 weeks for 39 weeks work and 5 weeks paid holiday)
- I have applied for a new job that is not term time only for a completely differrent organisation so would be working all year
- There are 5 weeks left 'til the end of term
- If I was lucky enough to be offered the new job I want to know when I should hand in my notice?

I've worked for 2 companies at the same time, taking leave in the last week as they didn't want to pay and starting the next job on the monday so effectively working for another company on a day's leave from the first; nothing illegal about it [think of how people have 2 jobs].If you haven't got it - please don't flaunt it. Did you only do it for a week though? I would be employed by them both for the whole 6 weeks of the holiday? I think I feel "naughty" if I didn't tell them but I don't want to lose my already earned money?

There is nothing "illegal" per se about what you suggest. But That does not mean you can do it. You need to check your terms of employment to make sure that there is nothing in there that might cause problems. If you are still in employment then the current employer may, if they just find out, get shirty. We recently had someone with the same type of contract being made redundant whose employer expected them to turn up during the notice period even though it was not term time. I cannot see any reason why you cannot just ask - if, as you say, you have completed your contracted hours then there should be no problem, but it is better to be sure than sorry.0

I have looked in my old contract and there is no mention of this? Things are very difficult at the school atm as we were turned into an academy in April and are now not run by the local authority. We have not as yet had any new contract. When I left my term time only job, there was an adjustment for the term time only pay / owed holiday in my last pay packet. LEA HR are very used to this and you shouldn't lose out - I got more than I expected!0

It should not matter what the contract says you have worked the hours/weeks so the holiday pay is due when you leave as it has allready accrued.
When does the holiday years start/end I hough for term time it was always the Sept dates.0 -

A - if it doesn't say that you CAN'T work during the summer hols then take it that you can. If it was an issue it would have been written into the contract.
B - Nothing that you say to the personnel manager is in confidence....they work for the company not for you.
If you do, you might bring attention to the issue. And as such, scupper your plans.If you haven't got it - please don't flaunt it. TIA.0
