Advice on claiming for hardship needed

I previously tried to claim bank charges back in 2007, was due approx £2000 however the test case stay kicked in 2 days into my small claims court hearing. My particular case was pulled, gutting really as the money would have gone a long way to settling my debts at the time!!

I've recently lost my job and counting back 6 years it appears I could still possibly claim approx £500. I'm not too sure on the rules for claiming for hardship and the best way to do it, obviously my recent loss of job has left me with considerably less incomings, but is it likely I will be able to go back the 6 years and reclaim charges paid out whilst I was earning?I do still owe out a few thousand pounds in credit card, store card and overdraft debt, and yet again any money I could claim would come in handy for settling these debts before they become a burden.

    There is a sticky at the top of the page with information on claiming due to financial hardship. However any repayment is purely at the discretion of the banks and people are generally reporting a maximum of 6 months rather then 6 years.

    Its unlikely the bank charges of £500 have put you in hardship. You were either in it before you lost your job and then it would be your spending habits or you have gone into hardship now charges not being a factor.

    The bank charges have to have a material affect on you and £500 over 6 years when you were working are unlikely to be viewed that way. You can of course try and you may get a goodwill payment but, based only what you have said, your case is not strong.

  • mmm I was sort of thinking this would be the case, I've paid no fees whatsoever for the last 6 months so don't think I'll bother! Cheers for letting us know anyway, saved me the effort...
