Quick easy question

Hi I'm hoping someone will know the answer to this straight away.

Does my solicitor automatically get sent a copy of the survey or do I have to photocopy mine and give it to them??

    If you want the solicitor to have a copy, you either need to photocopy it or pay the surveyor to send a copy. But solicitors do not need to see the full survey, they only need to see the bits they can help on. If the place is falling down, YOU need to read that bit and make YOUR decision. Your solicitor became a solicitor because he could not cope with mechanical engineering. If there are legal issues the surveyor has picked up on, you need to copy those pages to the solicitor - this will be more satisfactory than expecting the solicitor to read the whole report and get to the bottom of it.

    Thanks I've done the right thing then, I've copied the pages I need their help with. It's not falling down but there are a few things that it asks us to investigate eg old electrics and heating system.

    That's not your solicitor's problem to deal with. What are you asking them to do?

    It asks for some certificates and vendors previously mentioned they had the boiler checked so I'm asking the solicitor to obtain the certificates. Is that the right thing to do?

    Unless the certificates are Planning Permission or Buildings Regulations (ie legal requirements), it's hardly worth bothering.

    So you find out the boiler was serviced a year ago - doesn't mean it works now. Nor will it tell you how much life it can be expected to still have in it.

    If you want to know the current condition of the electrics, pay qualified electrician to inspect.
    If you want to know the current condition of the boiler, pay qualified heating engineer to inspect.

    OK - hesitate to split hairs here but....
    Planning Permission or Buildings Regulations (ie legal requirements),
    Electric/boiler certificates are documents, so legal points.(ie paperwork connected with the property.

    My,er..., point, is that the boiler/electric certs are a) not legal requirements - some people have them, some don't - and b) they have little practical value for the reasons I gave above.

    In terms of proving that the process for dealing with the state of the boiler is correct, then it is the right thing to do. In terms of getting a sensible answer as to whether the boiler is OK, you would do better to ask your dentist - the dentist will be better placed to answer such a question than your solicitor will.

    they are indeed legal requirements for the seller to have, and the buyer rightly is asking for them.

    but I agree with GM, don't ever rely on certificates from a seller, always do your own.

    If they have the correct certificates why would I need to pay to do my own? That seems like a waste of money?
