Tax credits after maternity pay

I AM NEW SO LADIES AND GENTS SORRY IF I APPEAR TO ASK THE OBVIOUS. I NEED YOUR HELP AND EXPERTISE
My partner was receiving maternity pay until May 2011 when the 39 weeks ended. As she is not going back to work I have applied for WTC. I work full time and my gross pay is £15890. My partner has no income. Before she went on maternity pay she was earning £13500. After applying for wtc they told us that we do not qualify as our combined earnings are higher. This despite explaining to them that we are only living on my salary and my partner is no longer receiving SMP. We also explained to them that she is not going back to work when maternity ends.
After speaking to them they are now asking me to complete a change of circumstances form. This is our first ever application and as far as I am aware there are no circumstances that have changed other than what they already know which is on the form we completed. Are they right on basing their decision on my partner and i previous combined wage

Hi, yes they are correct however you can ask to be assessed on this year's estimated income and this will be what the new forms are for.
Be careful though and make sure you tell them of every change of circumstance this year, as this is when an overpayment can occur because you will not be covered by the normal £10K disregard.Sometimes it seems that just when I think I have reached rock bottom, someone hands me a shovel.0 -
