It gets worse - I've also bought a fake item - help!

Updated as I'm now unsure if the item is fake or not - it's so confusing.

You can open a SNAD dispute through Paypal (not Ebay - Paypal is better for this, apparently!) - Significantly Not As Described. You will have to return the item to the seller, but as it's a fake I believe the seller has to pay your return fees. Paypal will refund your money.

However, this has to be done in a certain timeframe from the sale, and I'm not sure what that is; I'm sure someone else will be able to help out. You can always check the Ebay pages for SNAD help.

OP I don't know the original question as you have edited it.

Kiki - Paypal is generally better for any dispute EXCEPT fakes. Ebay is best as the onus is on the seller to prove authenticity with an Ebay dispute. With Paypal, you have ten days from dispute opening to prove the item you bought is a fake.

In either case, there is no Paypal or Ebay enforceable way to make the seller pay return postage. With fakes Ebay usually ask you to destroy it.

Thanks for the info, that's very helpful. So Paypal always *except* in the one case where I decide to reply to someone! Typical!

The OP's post was about a DS game and its un-usability in different consoles making it fake, but obviously that's perhaps not the case anymore.

I'm sure they will fall into line eventually but at the moment Ebay is best for fakes but Paypal for absolutely everything else. Although, there have been some Ebay dispute threads on here which have been long and drawn out but have resulted in no fault refunds, ie the buyer keeps the item and the money is refunded. But personally, I would rather it was dealt with quickly and with the staff knowing a little about their rules, than the eejits at Ebay and their own interpretation of the rules!

Hi everyone, yes it was about a DS Game. Looking on the internet it seems that consoles issue as stated by the seller was correct and doesn't indicate it's a fake, but after even more googling the reasons I now think that this was used to mask the fact it's a fake is that there's no serial number on the circuit board and also having actually looked at the booklet myself the pages aren't even printed straight.

I've got myself in a silly situation here, I don't really know what to do as I already left positive feedback and I bought it on the 1st June.

Your easiest option is to open a SNAD (significantly not as described) in Paypal. Then escalate it. Then you will be told to send it back tracked (at your expense). You will get your money back once it shows as delivered/attempted delivery/refusal. But it will cost you the returns postage.

The best option is to open claim in Ebay that the item is FAKE. The seller then has to show the item is authentic. You won't have to send the item back but this type of dispute can be drawn out and lengthy in process.

You have two very easy options, but you only have 45 days from purchase to decide. Why don't know what to do? Feedback is NOTHING at all to do with it and will NOT be taken into account.

Hi everyone, thanks for the advice. Seems I was just panicking. I emailed the seller and they issued a full and immediate refund. I'm pretty sure they are a genuine seller and this was an unfortunate case. I'll try not to let it put me off ebay, but I will be more cautious with games now!
