no box no refund

Hi .. i recently bought a usb charging cable for my HTC ledgend phone, which when i got it home took 16 hours to charge it up, so i borrowed a freinds cable to see if the fault was on my phone, his cable took 2 hours to charge as did my old cable, so i repeated this experiment again and found the same results, so i returned the goods to the shop who checked the charging rate and said it was fine, but then checked it against a genuine HTC cable and there was a different charging rate, so i asked for a replacment or my money back and they refused on the grounds that i had not got the box it was sold in as the supplyer would not take it back without it.My question is simple is this legal, and can i ask for my money back .......... ps recently bought a genuine htc cable and it works fine... regards :cool:

Can you not ask the shop to exchange it but leave the new box behind? So the shop is left with the product and a box and your left with a product and no box.

I work in a small shop and thats what we do.

You don't need the box/packaging if the item is faulty, however, going by your post, the cable isn't faulty just not as good as a genuine cable. In which case the retailer can impose whatever terms they see fit.
