Can daughter buy our council house then rent it to me?

    If you love the house so much, let the HA keep it and rent it. Once you/your daughter buy it it's possible to lose it overnight through not paying a mortgage, or other debts growing and the house being grabbed.

    Then how'd you feel?

    The rules on being allowed HB when renting from family members are complicated (to prevent fiddling amongst other things./.. ...)

    indeed but referring to the OP's plan the answer is shown on the first sentence:
    " If you are renting a home from a family member and they live in the same house, you won't be able to get housing benefit, even if you are paying them rent. "

    The daughter is the part owner, lives there as mother's LL, yet expects the taxpayer to fund the mothers HB so as to line the daughter's pocket

  • Thank you all for your replies but I think I have given you the wrong impression about me and my family
    My daughter and I and up to three others if they have lived with me could all buy my house together if we want , under the right to buy.
    Most probably will anyway as then my family can keep the house when I die. Until I became ill I worked hard and have made this house our home. When I was working I put a lot of money and effort into this house for my family, and would love for them to benefit from it for a long time

    Not trying to be dishonest or sneaky here just asking so I know if I can assist with the household bills, the only money I get is £18 housing benefit, child benefit and DLA and I pay out for my personal care from this.
    My daughter probably wouldn’t want any money of me anyway, she is talking about putting in a ground floor extension granny type flat for me with full disabled facilities. My daughter works hard for her money and could afford the mortgage.
    My daughter would buy the house opposite from us if she doesn’t buy this one however that would be a buy to let as it is a property split into flats.

    Please don’t get the wrong idea about me and my daughter, my daughter just knows how much I am worrying about them losing this house I have put so much work into that’s why she would buy it.
  • I assume the £26,000 discount is what the HA told you and isn't from a friend or an outsider?

    The reason I ask is because you may not be able to buy the property if it has been specifically designed for an elderly or disabled occupant.

    can you get daughter added to the tenancy agreement so she can stay there later?
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    Yes the HA has told me that this is the discount and I can buy it even though it is adapted

    The HA wont let me add daughter to the tenancy agreement even though she has lived here all her life I did already ask them when my health started getting worse (think its because its been adapted for disabled use )

    Have you acquired the tenancy by succession? If not then your daughter can take over the tenancy on your death. Although if it's adapted she may be asked to move elsewhere into a non adapted rental.

    Suggest you go see local CaB or Shelter and ask for them to see if your benefits are OK or if you are entitled to any more - additional, new, benefit or extra on a current one..

    ?? Council Tax Benefit, WTC/CTC, dunno how old you are but maybe pension credit etc etc etc?? (eg if disability is getting worse should your DLA level be increased?? )

    Not sure what the exact rules are on HA right2buy but would it help daughter being able to buy in her own name if she was added to the tenancy (if she ain't on the tenancy already??).

    Maybe read - very carefully - the rules of your HA right2buy scheme...

    No, only the tenant can buy the house under the right to buy.

    This is not true.

    "You can make a ‘joint application’ to buy your home through Right to Buy with someone who shares the tenancy with you or with members of your family. They must have lived with you for the past 12 months."
