HSBC bank charges

Hello,

I received a letter yesterday from my bank (HSBC) stating that due being unable to honour a Standing Order of my rent they had charged me £25 for considering allowing me to go further into my overdraft.

On Saturday I put a cheque into the account for £2,000 from my Grandparents but the two missed each other.

I have been struggling financially for awhile (a long while...) and I have had no choice but to live in my overdraft, due to my hours being cut right back I am claiming jobseekers to top up my income and I'm still waiting a month after making the claim.

I have spoken to the JC who say that they can be held responsible, my bank say the chage stands as due to my history etc etc. I've argued that its unfair as it doesnt represent how much it costs them but up to yet they arent budging.

    The unfair argument is no longer valid since the court case. Would suggest writing to them and saying that you are in financial hardship at the moment due to a change in circumstances and could they refund it as a goodwill gesture.

    Your argument is not valid.

    You are reliant on their goodwill. Normally they will refund on first offence (or first offence that year with some). However, you say you have a history and that suggests you are a frequent offender.

  • Your claim is completely unfounded. It is YOUR responsibility to ensure there are sufficient cleared funds available at the start of the day to cover any items presented. A cheque paid in on a Saturday would be processed on the Monday night and be available to use on the Thursday.

    You do not say which day the Standing Order was presented for payment, but as you say they 'missed each other' I presume it was perhaps the Monday?

    If there are not funds available to pay the items, then the bank are not obliged to pay them.

    End of story.
    Before you ask, yes, I work for a bank, but no, I didn't get a bonus!
