House taken off the market, but still advertised by the agent.

My Father, 88 years old, was obliged to pay £250.00 for taking his house off the market over a week ago, one of the reasons was because the manager of Bairstowe Eves, the Clacton-On-Sea agence was inefficient and arrogant.:mad:

Today I have seen that my Fathers house is still advertised for sale in this same agence, is there any way my Father can benefit from compensation?

    The estate agents are entitled to payment for their work to date.

    Your father chose to settle this debt. What is the problem?

    Give them a call or drop them an email asking them to stop advertising. Probably just keeping it on to make their stock look bigger.

    There is no grounds for compensation.
  • Someone posted earlier that the Agency could be charged with false publicity...by the time i could again log in the post had disappered, i would like all the same to thank that person.

    Caroline73..what work to date? posting my Fathers house on the net, two visits, the 'a very tired for sale sign' that my Father from the very beginning stated that he didn't want but was planted all the same! If Bairstowe Eves had found a buyer for the house they would have pocketed the £250 along with their fees anyway.

    I just want to know if some compensation is due concerning the fact that his house is still advertised this day when it has already been taken off the market...

    With this recent problem my Father is unable to spend a few days with his club friends for a short holiday in Wales, they are all old aged pensioners...my Father being one of the eldest and pratically deaf...

    just to mention, that aged people are so Venerable

    I assume the estate agent did a valuation, took photos, paid the people who erected the sign, put the details on the website, called people who are looking for houses etc. Obviously I don't know everything but I'm sure that list isn't exhaustive.

    Your father has not lost anything by the house details still being on the website so there is no compensation due. There is no loss to compensate him for.

    My Father termined the contract. He paid to have that contract stopped, why then is the agency still publicising his house on the net, for me they have not respected the normalities....as GAH posted its probably 'just keeping it on to make their stock look bigger'...yep, just that!!...

    I need to dig further.

    Don't think there is any digging to do :S
    It is standard to pay a removal fee. It covers all the advertising preping and planning the agent does to get it on the market.
    You come off teh market, it doesn't sell. The fee covers their work.

    Have you thought it may be as simple as someone has forgotten to trake it off the net?

    I'm sorry but why on earth should your father get compensation?!?!?!?

    Call them. Say it seems to still be on the internet,can it be taken off today please.

    Just for arguments sake, why don't you get someone to ring the agency and enquire about the property as a prospective buyer? If they instantly tell you "I'm sorry that property is no longer on our books" you know its an oversight.

    I agree with others here, whilst its annoying its not really a compensation issue. Agent will have incurred costs, which he would have recovered at the point of sale. If the house is removed from his books, he has a right to charge for these costs - hence the fee required from your father. Did your father pay a registration fee when he put it on the market with them? When we were selling last year, our agent requested a £250 up front fee. It was non-refundable and the terms stated that it was to cover marketing set-up costs and admin, as people do get them out to measure, draw up details etc, then change their minds, so they take the fee upfront to avoid this.

    If your father paid nothing, then I cannot really see what you are hoping to achieve as there is no way the agent will refund the fee for work he has actually done on your father's behalf!
