Tiger Tiger in Newcastle upon Tyne, advice needed

Firstly we live in Northern Ireland, and in September this year I think it was, my wife booked a room there for my daughters 21st. She was told the room needed a deposit of £200 which she could cover using her credit card, my wife did this and was told as soon as the bar takings exceeded £200 the room would be free and this was just to "book" the room, which is reasonable enough.

My daughter had her party on 31st October, loads of friends came and typically ! they spent loads in the bar, well in excess of £200. Her CC statement for November didn't show the refund, we assumed this would be the case as it was probably produced at the start of the month.

December statement, still no refund, my wife phones..."we'll get back to you"..my wife has actually flown to Newcastle now to sort it.

On Tuesday when she actually called in she was told, "This £200 was charged against your bar tab"...my wife said they didn't have a bar tab, they paid for all their drinks there and then...."Oh we'll phone you...."

You guessed....they didn't phone, my wife called them....oh yes we'll sort it out....my wife then asked how can you use my credit card against someone elses drinks tab....silence....they say we will phone you on Saturday (yesterday)

Well, you guessed....no phone call...so much for I'll phone you back....my wife phones, was told then...we'll sort it out if you call Sunday, we'll refund you....my wife phoned this morning, the "restaurant manager" and I use the term loosley as she hasn't managed anything yet, is not there today....and will not be in on Sunday at all....DOH!!!!!!

QUESTION: Has my wifes CC been fraudulently used by someone, possibly a staff member?

Blimey they talk about watching crooks on the street, I don't know if this is incompetance, bad management or something more serious.

I am now loooking at a chargeback situation and possibly more.

Anyone have any views on the legal aspect of this sort of thing, what sort of redress you have, and being compensated for all the time and expense and hassle of having to go back to Newcastle and run after them.
