my other question is, lets say now that i go to the other insurer direct, what if their customer denies the incident? where would i stand? i am asking all these questions as if that is a possibility then it may be wise for me to stick with helphire after all.:j0

If you ring them and ask them about repairing your car they will tell you straight away if their client has reported the accident and whether they have accepted liability.
Helphire will probably pursue the other Insurer for the £200 but if it's not paid they often write these types of amounts off. If they do come after you just put in an official complaint and they will normally drop it0 -
.........Personally I would ring the other Insurer direct and get them to repair the car, if it causes problems for Helphire so be it.
Do you have the other insurance companies details
That’s what I’d suggest too, with the proviso that they also agree to indemnify you for the costs that Albany have already incurred.
If they won’t do that (by email) then I’d stick with Albany and let them provide you with an equivalent replacement car whilst yours is being repaired0 -
ok, thanks for all the help! ive go a credit protection policy so that should cover me if they were to try and come back at me for the costs anyway shouldnt it.
ill ring the third parties insurance company tomorrow and see what they say.:j0 -
As you have the credit protection policy you won’t have to pay anything as long as you stick with the terms of the credit agreement.
I’d say that taking the repair out of the credit agreement is breaking that agreement (and thus making you liable for the costs) which is why I'd getd written confirmation that the third party insurer will indemnify you for those costs before you make a decision.0 -

thats what i thought. however, its not me breaking out of the agreement its helphire. they are the ones saying they will not do repairs and so are advising me to go to the third parties insurance.
therefore if they break the agreement do i still have to comply with the terms of it? also if they want to end the agreement shall i get them to say that in writing? if so does it have to be a letter or would an email be just as good? i want to cover my back in every way possible so they dont come back to me for money.
again like you say if i go with the third parties insurance to get them to send written confirmation that they idemnify me for the costs can thsi be email or does it need to be in a letter form?
thankyou for all you help:):j0 -
sorry just read back over your post 14 and can see you have put BY EMAIL so i assume that email is fine to use as written confirmation.:j0

just reading through my agreements etc and it seems that on the vehicle hire agreement it states that i cancel the policy within 14 days by notifying helphire, if i do so i will still be liabel for the charges incurred upto that point. it says cancellation of this agreement may also cancel your insurance policy that covers you from deferred charges.
Now so i come into that catagory? i didnt actually say i wanted to cancel the policy but that i no longer needed the car? but then does that class as the same thing? if so they may be able to come back to me for the charges?
they doestn seem fair. what if i had broke my arm and had to cancel the policy?:j0 -
finally after a lot of calling around i get a direct answer.
i have now been told they will not go ahead with the repairs becuase i do not require the hire vehicle. i have been advised that i can go ahead and claim through the TPI but that the at this moment they have no note of an accident (The driver has not reported it).
I got the manager at Helphire to confirm with me that i will not be liable for the time i had the hire vehicle and she said no i wont be liable.
I also got her to confirm with me that if Saga ask questions with regards to the hire car I am to say that I had it for a day but then no longer needed it and so it was collected.
I got her to send me all this via an email so i have a fall back should they go against this.
Have now called Saga and they are going to cntact their client to ask about the claim. She has told me that until he accepts liablity they will no be able to help me but will keep me informed.
So i assume if he does not accept liablity then i will not be getting my car fixed. I hope it doesnt come to that:j0
