I tried the chargeback option with the bank again and although they were very pleasant they wouldn't budge. They said under Visa rules as I have 'volunteered' by details they had no cause to claim back. :-( So let the letter writing commence.

What's adding to my annoyance is that I am self employed and therefore spending alot os time on this and losing money!

It's just a slogan, nothing more. The only good clamping company is one whose staff and members jump from Humber Bridge.

They report that the court comes down on the side of the clamper because the driver accepts the conditions. Cobblers. Why then don't the PPCs go after their pound of flesh? What happened to the argument that the demand does not reflect actual losses? How does "I consent" allow the antagonist to contravene civil law? PPCs have gone to court AND lost on these shallow arguments. I would personally throw the book at the judge on this one.

Really though, should've just claimed that, as your daughter is your "little princess" that they have clamped a car that was there to protect royalty, and therefore could end up in magistrates court again.

my take: 'volunteering' is IMO not the same as 'volunteering under duress', so there could be some mileage using this wordplay by doing as peter the piper suggests and being persistent with the CC co.

I won't pretend knowledge on this, but - given that time is important to you - persistence might be an avenue worth exploring before you consider the option of court.

sorry I can't be of more help on this but you've really got my sympathy; many a night I've gone to bed praying to the Almighty that he send bolts of lightning to 'kebab' the clampers.
  • I take it your CC company deny section 75 refunds if you "volunteer" your information as well??

    Oh right; thought not.

First stage of my fight going wheel - have made front page of the Surrey advertiser with headline "Three minutes cost £200 as mum drops child at playgroup".

Shoal made a statement: "This vehicle was parked without a permit. We have listened to the recording of the call and confirm she was explained appeals process" Thanks for those words of wisdom. Also Landlords named.
    Letter writing this weekend!

    Keep the pressure up.

Have you checked the SIA site to make sure your clamper was licensed and his licence is up to date?

Which of course they will be able to produce in evidence at County Court..... or might go mysteriously missing.
