Help! Don't know what to do next...

So long story short I bought a freeview recorder from an ebay shop in January and it has broken.
We want for them to repair or replace the item and have spoken to Consumer Direct who have told us that we are entitled to this under the Sale of Goods act 1979 (as amended).
However we have contacted the seller and they keep referring back to the fact that the item had a 90 day warranty and they can't help us any further so...What do I do now??

Silence is golden...unless you have a toddler. In that case silence is very, very suspicious!
