How do you go about getting a matrimonial Order?

As their daughter is 15, she will only get child support for a short time, usually until the child is 18 if she stays in education.
Your friend really needs to see a solicitor. She may not accept the marriage is over but she should have her options explained to her.0 -
it is possible to get spousal maintenance still but unlikely, I think, with what is a relatively small disparity between their incomes. Once she has Tax Credit in place, and child maintenance, they're going to be in much the same situation I should think. Has she let her council know she's on her own? That will result in a reduction of her council tax bill at least.
It's a terrible shock and takes a long while to accept. It is likely at some point he will want to come back - it seems to be the pattern. However, it is often only when life goes wrong (other woman throws them out!) that the 'leaver' makes such a move. Hopefully she'll be stronger at that point. Is there someone else involved? If she thinks not, I would try and prepare yourself for the fall out as the chances are someone else is involved (if that makes sense). It's a far bigger thing to have to deal with than being left. Hope she gets things sorted - she can find advice and support on https://www.wikivorce.com which for me and many others was a lifesaver in times of need.0 -
Yes there is someone else involved she has found that out, and i agree at some point as its only early days they will fall out and he will be back at her door.Although he has told her they have been together a year looking back she thinks its been a couple of months and you may ask why would he say a year if its not true ,she who i will call Linda thinks people would call him stupid to leave a marriage of 26 years for a woman he's only been seeing for two months.
At the moment she been working out all dates and bank statements etc trying to piece it together.
Time will tell and i don't personally think that would be right reason to have him back but at the moment she will do anything to get him back.
So seems she will forgive anything and thats her choice , i will just be there for her .0 -
Spousal maintenance does still exist and you can claim £1 a year after a divorce (if the court agrees) which you never actually collect but means it is in place so if he gets a huge wage in the future then you can apply for it to increased.
Not saying I think this is right but it is the case none the less. My solicitor explained it to be but I said no thanks I just want the clean break end of,"Life is what you make of it, whoever got anywhere without some passion and ambition?0
