A problem with amazon and a marketplace seller

Recently, on May 14th, i bought some Beats By Dr Dre headphones (Studio) from amazon.co.uk via a marketplace seller.
Anyway around 2 and half weeks down the line, i was struggling for some cash so i decided to part with the headphones.
I went into my local cex shop to see if i could sell them, one of guys noticed straight away that the ones i had were fake. I was absolutely shocked about this and i didn't even know that they were. They compared the real, original ones to mines and they were indeed fake.
So anyway, i went back home and sent an angry email to the seller, he responded saying 'oh it took you this long for you to say they were fake' and the usual crap you get from scums like him.
Anyway i exchanged a few angry emails with him and decided to file an Amazon A-Z guarantee claim. The seller responses made me feel that he knew exactly that what he was selling me he knew for well they were fake.
Around a few weeks after filling the claim with amazon, they said i need to provide proof that they are fake. So i contacted the manufacturer of the headphones and they couldn't tell me by the pictures that that the ones i had were fake or not, they said people usually copy the serial number onto the fake ones, but i know for for fact they are fake because the number 6 on the headphones don't even look like the original ones, the headphones are little smaller and dont have that glossy look, and the part where you put the batteries in are different to the original ones.
I replied to the email that amazon sent me including the reply i got from one of the Manufactures representatives, but amazon have yet to reply back and the deadline they set for the case to be concluded has passed by nearly a week.
If i can't get this sorted by amazon - I want a full refund, is there any options i can consider? like a small claims court? If so how do i go about this?
Btw, i didn't use a credit card, im 17, however i did by by a visa card - I contacted the bank about this, they sent me a dispute form to fill out but i guess there's nothing they can do if i can't provide proof they are fake.
Please, what can i do, i am really stressed out about this, i spent a lot of money on a fake piece of junk.
Thanks

What feedback does the marketplace seller have?Gone ... or have I?0

Mine which was one out five and just one other which was 4/5. Interesting thing about this was the buyer commented that the headphones that he bought broke but was quickly replaced by the seller. I don't know if it was the same headphones as mine, but this suggest what he sells are not the real thing.0

You're not gonna like this OP, bearing in mind what you posted here about "been (sic) talked to like they are a child."
But amazon still you consider you a child:
http://www.amazon.co.uk/gp/help/customer/display.html/ref=footer_cou?ie=UTF8&nodeId=104061619. Children
Amazon.co.uk does not sell products for purchase by children. We sell children's products for purchase by adults. If you are under 18, you may use Amazon.co.uk only with the involvement of a parent or guardian.
I suggest you refer the matter to your parent or guardian involved in the purchase for help now."Now to trolling as a concept. .... Personally, I've always found it a little sad that people choose to spend such a large proportion of their lives in this way but they do, and we have to deal with it." - MSE Forum Manager 6th July 20100 -
Is it possible to ask monster if you can send them the headphones for verification that they are fake? Then provide the proof to amazon?
As a lover of headphones, just a suggestion. You can get the same or better quality headphones then the beats for a much lower price. True the beats are nice but they're way overpriced. You're paying for the design and the fact they're endorsed by Dr. Dre.
Best of luck getting this resolved.I try to help as much as I can. But I'm also honest and speak my mind.
