Getting a car-tax refund

I wrote my car off, and the insurance company picked it up and took it miles and miles away. Despite repeatedly asking, I can't get the tax disc back.

I understand I can claim a refund, and as I went on the dvla website, I think I should be declaring it SORN. Is this correct, or am I selling it to the insurance company (today they made me an offer I will finally accept) and not worrying about it?
Can we just take it as read I didn't mean to offend you?

    Sorry, that wasn't very clear - there's a number of things I was asking in the same post. Anyone help?

    When you sign it over to them, agree in writing it does not include the tax disk, and declare it missing when you apply for a refund.

    speak to swansea because once you roll the log book to insurer they automatically advise swansea of its category statue eg cat c by electronic means,now its quite possible they also get logged as tax disc owner too which means they get tax cash
    therefore DO NOT send log book off until tomorrow and in any case fill in the top right hand corner of the log book with insurers details on it to rid you of any lien once car is no longer yours
    they should request rest of log book if they are a decent insurer under abi guidlines,but many are very sloppy

    Thanks. they've already said to me that I can apply for the disc to be refunded now and that I don't need it.

    I think I'lll just phone up Swansea tomorrow.

    I'm ex DVLA and it used to be the case that you could get a separate form to apply for a refund of tax disc when it was not able to be sent in for reasons like yours. For the life of me I cannot remember the form number sorry (never thought I'd forget it!) but when you ring DVLA tomorrow they should be able to post one out to you, unless things have changed.

    You don't need to declare SORN though, you just need to send off the correct bit from your logbook (section 9 - yellow?) to tell DVLA that you have passed vehicle to insurance company.

    You have to post a decelaration, they can't do it by phone.

    transferred ownership, but you have to have notified the dvla first, so............
