Expensive watch repair not good enough

Hi all,

I had the crystal face of my dress watch replaced at Goldsmiths Jewellers. It cost me £90, I had it done over a year ago (so it is beyond the warranty they gave) and at the time it looked ok. But as I don't wear that watch very often it took until now for me to realise that there is a huge gap down one side of the crystal and, so, dust and hairs are getting into the watch. This will obviously affect the working with time and it itsn't waterproof, so I don't dare wear it any more.

I haven't been back to Goldsmiths yet, as I wanted to check what rights, if any, I have for their substandard workmanship.

    I think after this period of time they would consider you to have accepted the work done.

    To be honest, you've had the over a year to spot a fault which in your own words is "a huge gap", so I doubt very much if you will get anywhere with a complaint.
    As it now stands, Goldsmiths have no way of knowing if the fault was anything to do with them or if any further work has been done to the watch since they had it.

    The SOGA gives a good explanation as to when you can be deemed to have accepted goods:
    (4)The buyer is also deemed to have accepted the goods when after the lapse of a reasonable time he retains the goods without intimating to the seller that he has rejected them.

    Thank you guys. Just as I thought. The problem was the 'huge gap' wasn't really noticeable until dust and stuff started gathering in it. I'll take it somewhere else next time!

    I would go in and give them an opportunity.

    My nephew works as an horologist, and indeed he did work for that company - I believe they would at least be reasonable, if OP approaches them reasonably - it is mostly labour anyway
