Amazon Market Place Seller - Have I lost £35?

I'll keep this short and down to the facts.

Two months back I bought an item which included delivery totalling £35 from a seller on the Amazon Market Place.

The items didn't turn up yet DHL stated the item as delivered. I logged a complaint with Amazon to claim on their A to Z policy yet it was declined because the seller provided a tracking number stating delivered (which to be fair it did).

I then contacted DHL to dispute the delivery and they placed a 'trace' on the package. After an investigation they stated to me that the package has been logged as lost but the sender must register a claim.

I contacted the seller via Amazon and requested them to do this and then to provide me with a full refund. The seller told me that will do this and update me shortly. I waited 8 days and asked for an update only to be told "3 more days".

The seller now doesn't respond to my email and Amazon will refuse to help because "the item has been delivered"... and believe me I have tried.


I'm after advice on what to do next? I've emailed the seller stating that without a response within 14 days I'll start legal action... this time is now up!

I'm at the point that I don't want to let this go out of principle but seems to be stuck. I only know the name of the business used on Amazon market place BUT its just a random name and Amazon will NOT provide any more details.

Where do I go next?? :(

    I would email/call the guy again. I would ask dhl to confirm what they said (that its lost). Send that to amazon. Failing that, and this always works for me, i call every day (sometimes twice) to "check on my status" eg.hows everything going, eventually they get the message and understand you are not leaving.

    If the seller isn't responding then just make a chargeback claim with your bank. I would always advise attempting to contact the seller first be it Amazon or another website as opposed to just making a chargeback claim but as you have already done this get the ball rolling, leave them to sort it. You wil soon get your money back.

    Amazon will not fall for this harrassment, at the end of the day the customer service can do no more than tell you what they already have done.

    If the seller isn't responding then just make a chargeback claim with your bank.     Amazon will not fall for this harrassment, at the end of the day the customer service can do no more than tell you what they already have done.

    We used a pre-paid mastercard... it was actually something the OH got from work otherwise we wouldn't use that sort of thing. I don't believe I can do a charge-back with that?
