Dla appeal new evidence

Hello
Am i right in thinking that you were already getting low rate care and then asked for an increased award as your health/disability worsened?
If this is the case then be aware that the tribunal and the DWP can (and often do) look at the whole award and there is always a chance of losing your existing award.
Make sure and get good supportive evidence from GP/consultant etc and submit to DWP beforehand-you could be very lucky as they may do a reconsideration.
Very best of luck

Thank you to those who have advised, your right I don't know a lot about ME/CFS but its all new to me. I am expecting to receive a booklet on this condition, so i can pass it around to family and friends. You are also right i receive DLA LRcare, this is an indefinate award i was not aware that they look at the whole claim, I thought they only looked at the whole claim on the renew/review claim. So you learn something new everyday. Thanks again.0

People see / hear what they want to see / hear in a written word, review / reconsider from your hopeful point of view means more.
Review looks at the information and evidence, reconsider decides whether the award is fixed at the correct current level for your care & mobility needs.
The award can go down as well as up, and that can be determined not only by increased / decreased care & mobility needs, but by current case law and directives.Disclaimer : Everything I write on this forum is my opinion. Thought i would give you an update and hpefully get some helpful advise. Had appeal yesterday, for a start they where shocked that i was currently in receipt of Incapacity benefit--so why did i need the ESA appeal, i told them that when i got my date for my ESA appeal i rang both the tribunal and DWP to cancel it and i told them what i was told, still claim because it will save you having a medical when we migrate to ESA (the tribunal was not at all impressed with this statement) I also told them that 3 years ago i was medically retired from DWP they where stunned that because of this i had subsequently failed medicals but the main medical 'disappeared' from the DWP bowels.
Anyway, i digress, the reason to give the update is they need to check with my specialist even though i had a letter fom him that i forwarded to the appeal some time back. They also need my GP medical notes for the past 2 years. Could they not ask me to get these for them prior to the appeal, it is a long distressing and difficult time for me. In your experiences how long do adjourments take? Can i do anything in the mean time to speed it up?
BTW my cousin is the typist as i can't any longer.0
