ipod touch battery issues

I don't know if anyone else here has had this issue.

I have a latest generation ipod touch. All was rosy with this until last week (it is about 5 months old) when the battery started draining rapidly for no obvious reason.

A search on the apple forums shows it is quite a common problem and none of the fixes suggested seem to work for me.

Has anyone else here had this problem and know a fix?

Does anyone know what my rights are re. returning this and getting a refund or have any experience of doing this? I bought it online, but would it be possible to go into an apple store to do this?

    If it's less than a year old ring up Apple and make a Genius Bar appointment at an Apple store. If there is a problem they will probably replace it, even if you didn't buy it from them.

    I have had major issues since updating my ipod touch 2 to ios 4. Battery dies in 2-3 days.
    Just read that ios 5 will be released in the Autumn, but will only update 3 + 4 generation
    ipods, so I am not supported as I have an older 2G ipod. I think if I paid for it I will be able
    to update. Just another way for Apple to squeeze even more money out of their customers.

    They didn't squeeze any money out of you. You gave them it.
