ipod touch battery issues

I don't know if anyone else here has had this issue.
I have a latest generation ipod touch. All was rosy with this until last week (it is about 5 months old) when the battery started draining rapidly for no obvious reason.
A search on the apple forums shows it is quite a common problem and none of the fixes suggested seem to work for me.
Has anyone else here had this problem and know a fix?
Does anyone know what my rights are re. returning this and getting a refund or have any experience of doing this? I bought it online, but would it be possible to go into an apple store to do this?

If it's less than a year old ring up Apple and make a Genius Bar appointment at an Apple store. If there is a problem they will probably replace it, even if you didn't buy it from them.0

I have had major issues since updating my ipod touch 2 to ios 4. Battery dies in 2-3 days.
Just read that ios 5 will be released in the Autumn, but will only update 3 + 4 generation
ipods, so I am not supported as I have an older 2G ipod. I think if I paid for it I will be able
to update. Just another way for Apple to squeeze even more money out of their customers.0 -
