Do I need Indemnity Insurance

I am selling my house and during the searches the buyer discovered that the extension on my house was built without permission of the builder. They want me to take out an indemnity policy to protect the buyer. I bought the house in 2002 and the extension was already built when I purchased it. The searches that we had done when we bought it never showed the extension was built without permission. Am I still liable for taking out an Indemnity policy even if I was not the one who built the extension or should I strive to take some action against the Estate Agent that sold us the house?
