Online order - shop now says price was incorrect

Hi all,

I'd be grateful for some advice. I put in an order yesterday evening to Jacobs Digital for a camera lens priced at £299. Since they are normally about £450 I thought it was quite a bargain. I paid with Visa debit and received an email confirmation of my payment and the price. Their website contains the following statement: "When placing an order either online or by telephone, full payment is taken from your credit/debit card immediately. This includes any products that may be out of stock at the time of placing your order. We will deliver out of stock products as soon as stocks arrive." I have not yet seen if the money has come out of my bank account but according to this statement it will have done.

Today my wife received a phone call saying that the price was wrong and could I call them. Since I got home late I could not call them, so emailed instead. I wrote the following:

"I will not be available on Friday to telephone you, and would in any case prefer that we dealt with this matter via email so that I have a full record of our correspondence.

My position is as follows. Since Jacobs Digital have sent me confirmation of my order at the original price, as below, they have entered into a contract with me, and so I expect them to honour the contract at the price agreed by both parties. "


What do I do if the company refuses to supply the lens?

    The third sticky at the top of the page explains why the seller is entitled to do this. Sorry but you've got no chance of buying at the original price now.

    There's nothing that you can do I'm afraid.
    Just about all online retailers state in their terms and conditions that a contract is only formed once the goods have been dispatched and that if there are any errors in pricing then they reserve the right not to sell at the advertised price.
