Bolier warrenty - not serviced by developer!

hey guys,
my boiler has a fault that is covered in the 5 year warranty.
the house was unsold for the first year, and the developer did not service it in the first year making the warranty void...and void for the next 3 years.
should the developer pay or am i stuck with the £350 bill?

I tend to agree with Doozergirl.
'Caveat Emptor' or 'buyer beware' is the phrase that is used when buying houses. Me thinks your solicitor should ahve asked about this at the time baring in mind that the house had stood a year before being sold.
It would also mean that you are unlikely to benefit from ant warranty n appliances as these would have commenced when the house attained 'practical completion'.Eat vegetables and fear no creditors, rather than eat duck and hide.0 -

The warranty can only be voided once.making the warranty void...and void for the next 3 years.
I'm with t'others. If there is no warranty in place and the property and all that is within it is now yours its your bill.should the developer pay or am i stuck with the £350 bill?
