Can I claim JSA if I voluntarily quit my job?

  • I've got a question. I've been in a new job for almost 6 weeks and it is just not for me. Finding all the rules and targets and comlpiances so stressful, so much so I've been to my doctor and am on anti depressants for stress. I an a single mum with 2 kids and a mortgage. If I left the job would I be given JSA as I am actively looking for another job because I can't stand the thought of going back on Monday?

    Well it's possible you'll be able to claim if you're on anti depressants because of work. But you will have a questioning and they can be tough sometimes. Have you made attempts at looking for other jobs? If so that will help your claim.
  • Thanks Sharon. Yes I have applied for other jobs. Have never left a job before but might just go in on Monday and tell them I'm working my notice.

    How long were you unemployed before starting this new job?

    There's something called the 'trial period rule'. This is an extract from a Jsa sanctions pdf >

    People who have been unemployed for some time may be able to take
    advantage of the “trial period rule”. Jobcentre Plus wants to give people the
    confidence to start a new job without the fear of being sanctioned if they leave
    voluntarily, however the rule for misconduct still applies.

    In general terms if the person has not been a full time student or in relevant education and has been continuously unemployed for at least 13 weeks before starting a job (of at least 16 hours a week) and, worked for at least 4 but no more than 12 weeks, they can leave without fear of sanction. However, this should be checked carefully with Jobcentre Plus before anybody relies on it as a basis to leave a job.


    It would be better if your new employer turned round to you and said they were going to let you go, but if not you 'could' walk out under the trial period rule but you'd need a bloody good reason for the Job centre inquisition that will surely follow.

    edit: I started a new job a few months back and hated it from day one. I did more job searching after I started that job than I had ever done before. I wanted out a.s.a.p but didn't want to sign on again if I could avoid it.
    Anyway, after 4 weeks they turned round to me and gave it the 'sorry but we're letting you go...' bit. 'Thank f~~# for that!' I said with a huge smile on my face :D I knew that was my ticket out and would avoid any hastle from JC.
    I had to tell JC what happened but I never heard any more about it. I don't know if they check with the employer or not.
  • I left a job I loved on 21 December as it was only temporary and I did not get paid through the holidays, so summer was a nightmare. This job was permanent and would give me and kids security. On paper the job sounded fine but reality is a nightmare. I know I'll have to work my notice but I honestly just don't want to go in on Monday.
