Halifax Visa Debit Card

Hi All,

This is the first post for myself and I could really do with some advise.

On April 28th I purchased goods to the value of £1350.00 and another £850 on the 31st May from a shop on my Halifax Visa Debit Card. The first transaction was completed in person and the second over the phone. Was informed by the shop owner that delivery would be 4 weeks. After hearing absolutely nothing I chased to find that the shop is no longer trading and empty.

I have informed my bank, they have confirmed that all funds for the above have left my account and have referred my case internally.
Unfortunately with no guarantee that they will recoup the funds at all.

I have looked on the Insolvency Service website and as yet there is nothing listed on the company or the individual. I have spoken with local trading Standards and the Police, as yet I seem totally powerless to retain any money.

I have since found out that the land lord let in bailiffs on behalf of the Taxman to recoup unpaid Tax = £77k, the bailiffs have sold all
the shops stock including several items which I have proof of purchase for. I contacted that bailiffs who would give me no info what so ever. I don't believe that the trader has been made bankrupt yet so have no idea if creditors are involved or where to contact any.

In short I thought that I would have the same statutory rights on my Halifax Visa Debit Card and I would with a Credit Card, my bank don't seem confidence inspiring in providing any further info.

How powerless am I and is there anything else I can do? After calling the bank they were happy for me to also pursue the money, however I don't want to jeopardise any chances I have in returning the money.

What can I do and what are my rights?

Any help or suggestions would be greatly appreciated.

Regards
Richard

    Hi Richard

    look at this site http://www.which.co.uk/consumer-rights/sale-of-goods/your-rights-when-paying-by-credit-card/chargeback-on-credit-and-debit-cards

it would appear you may have some chance of recovering your cash.

    Good luck

Hello there, Im sorry about the situation youre in.

    Hope you get it sorted.

May i respectfully advise that if yo have a credit card, always pay for anything over £100 with the credit card. You then have a section 75 protection where the cc company is equally responsible for refunds when things like this happen.

    Good luck
make the most of it, we are only here for the weekend.
and we will never, ever return.
  • Ironically, I have just cleared all my credit card debts and made the descision not to use it. Its a great feeling to have a 0 balance, going forward I will pay on it and transfer funds accordingly.

    Thanks
    Rich

Tell Halifax - formally, ie in writing - that you wish to make a visa chargeback claim.

    From a quick google search...

  • Hailfax said that it can take up to 90 days to claim this money back. If received the amount will automatically hit my account, should they be unsuccessful they will contact me.

I believe that they are in the process of looking into reclaiming the money. Its not confidence inspiring at all, I requested to speak to someone in this part of the business. Their response was "sorry we can only communicate via e-mail", it just seems really reactive. I am expecting someone to at least tell me how the case is progressing.

    Am I expecting too much?
