Can i do anything to get out of my rental agreement?

    do we have to wait until the 12 months is up and give 2 months notice to come out of the contract up until that date? but only give 1 months notice if we had already done the 12 months and the contract was effectively 'rolling on'?
    Oh and im not in Scotland im in Northamptonshire.

    No, on the 12th of August your tenancy ends, so if you don't want to stay, you need to move out on that date.

    What you need to do is tell your landlord that you are moving out one month before the end of the tenancy.

    So, if you tell him on the 12th of July, you can move out on the 12th of August.

    Hi the contract is for 12 months. to end on 12th August 2011.

    Again, if your tenancy started on 12th August 2010 for 12 months it will end on 11th August, not 12th August.
    If you haven't vacated on 12th August a periodic tenancy would have arised at that point and you will need to serve a 1 month notice to quit to end it.

    If she's in England she is only legally required to give one month notice.

    OP can vacate by expiry of fixed term without being required to give notice at all.
  • Frittered away i dont have the landlords address, aparantly he is in America. I find it hard to believe that the letting agent only has an email address for him but short of calling them liars i dont know what else to say to them to help me communicate with the landlord.
    I guess we are stuck then. we will probably lose out on the possibility of renting in the village and therefore on the school for our son. It just seems so cruel considering we have been model tenants all year and took the house on the understanding we could stay as long as we liked and give our children a settled home without having to keep moving them.

    And rent-a-tent, I feel your pain. I'm in Scotland and had to give the full two months notice. It was a nightmare trying to find a property that coincided with our move out date.

    Also, Eton Rifle... if you have a property in Scotland i'll be your tenant!

    It is legal, but ONLY at the specific point of the ending of the INITIAL fixed term part of the tenancy... so in this case 11th August.

    You signed up for 12 months. You wouldn't expect the landlord to end the agreement a month early without your consent. Why should you be able to end it early without his consent?
