Money taken from bank a/c without my permission - I'm in total despair :(

    excuse me if this appears a stupid question but is there any link between (BRISTOL & WEST BUILDING SOCIETY,BANK OF IRELAND) AND BARCLAYS i know first 2 are linked but have they any financial association with barclays,it's just after reading this post i just wanted to clarify this point many thanks

    As Allied International Credit isnt a part of barclays.

    So therefore the right to set off definately does not apply

    Complain to Barclays as they have no right to attempt to use the right of setting off in this case for a refund in that money as to allow you to write F&F letters to all other creditors seeing as Barclays have broken the law in this case

    And to all above posters who have said that they had the right to READ the info the OP puts before adding to your already useless post counts as not everything is as black and white as you all think it is

    Whether you are correct or not, I would imagine that eventually it would have ended up with the OP having a CCJ issued against them, which would surely have been worse for the OP.

    Even if the money was returned, I can't imagine any judge, going by the OP post particularly making no effort to settle the debt etc.. would allow someone to have £7500 in their bank account and say ok you can give them £1 token payments toward the money you owe.

    I guess it wouldn't be out of the question, that Barclays would freeze access to the OP bank account either.

    I suppose it depends on who is deemed to still 'own' the debt. The original debt was with Barclays not Allied so perhaps a right of set-off still exists but I'll leave that to the legals !

    It would depend on whether Barclays had sold the debt to AIC or if AIC were acting as a collection agent.

    If Barclays had simply contracted AIC to collect the debt then they are perfectly entitled to set off. If they had sold the debt to AIC then they are not entitled to set off. Their website claims that they collect on behalf of clients, which implies that the debt remains the property of the client (ie Barclays).

    Yep - I had a Barclaycard debt sold to HFO. Barclays then told me they couldnt touch my Barclays account as HFO owned the debt now. How true this is I have no idea.

    Dominic - I had something similar happen to me when I was with LLoyds TSB. I was burying my head in the sand and 1 day they took all my salary to pay off my credit card with them and then they bounced all of my dd's as they came out the same day my money was paid in so they tried to bill me for all their own doing...

    like yourself at the time I felt it was unlawful and found out they could do this after loads of arguing... But what I did was said to them how unfair they have been and I was prepared to pay them back and needed the money.. In my case they left me with £1 to last me a month!

    So I managed to broker a deal. I said to them that I would set up a payment plan we agreed £100 a month (I think) and then said I wanted my money back but I wouldnt agree to the plan until they gave me my money back and they could take 1st installment from that! They agreed to this I got my money back and withdrew it all cash and put it into another account not associated with them!

    you may want to try that and see if you can and remain calm and polite all the way thru thats what got me what I wanted.

    Once you have you money and the plan arranged take others advise and if you have further debts get yourself on a Debt Management Plan and they will re-negotiate with all your creditors and you can find yourself better off!

    With me what LLoyds TSB did was give me the kick up the backside I needed!

    Lets us know if you did get some of that money back!

    Bob Hope and no hope - what's the point in giving the poster hope, the money was owed and has been taken. Do you seriously think a begging letter pleading poverty will get the owed money put back into his account? Most bizarre.
