Fixed term contract ending

I have cross posted this on the employment board as well.
I was wondering if anyone could give me some advice.
My husband is on a fixed term contract which ends in 2 weeks. This is his 2nd contract within the organisation as his first permanent contract was terminated due to lack of funding. He has continuous service from Dec 2009 so not yet enough to qualify for any redundancy payment.
A suitable vacancy has come up that he is applying for, same responsibilities, pay, conditions and is also fixed term. His HR department has informed him that if he applies for the job and is offered it his employer will be enforcing a 6 week break in his employment and thus he will forfeit his continuous service, right to redundancy payment [which he would qualify for if still employed by them in Dec] and it will have pension implications. :mad:
I am trying to find as much information as possible to see if this is actually allowed. There is an EU directive on non discrimination of fixed term workers but this organisation seems to be ignoring it.
Any help will be gratefully received.
