Hi there, im new to register on the site but have been viewing it for some time.
I left the armed forces at the end of 2003 after serving 6 years and from about the end of 2004 approx i have been claiming a war disablement pension for lower back pain and for PTSD caused by my time in Iraq.
I have been told that outwith the war disablement pension i am entitled to claim for compensation for the PTSD as it is an ongoing thing.
Is this true as i haven't heard of anything to say it is but but thought i would ask to confirm it.

Speaking as a Royal British Legion rep, firstly was your PTSD included with the back injury for your War Pension claim? If it was, then it would hasve been included in your overall percentage assessment of disability.
There will be no extra money due to you unless your condition(s) deteriorate in which case you could put in a deterioration claim. However on a deterioration review such as this it is possible your percentage could be adjusted downwards if they believe you have actually improved. Hence seek advice from such as the Legion, RAFA etc before applying.
You do not come under the Armed Forces Compensation Scheme which does pay out lump sums for injury/disability as your injury occurred pre 5th April 2005.
Your only other option would have been to sue the MOD as Crown Immunity ended in the 1980's. However it is probably way too late over 8 years later. In any case most of any sum awarded is usually deducted from a War Pension anyway as you cannot be compensated twice by the MOD for the same injury.
