Section 75 Advice please

Hi - please can anyone advise me - I live in Spain but have paid a deposit using my UK credit card for a new car from a Spanish dealer - and paid the balance in cash. My account is UK based and the direct debit comes from a UK based bank account. It looks as though the company is going to the wall and I will not get my car.

Assuming this happens, am I covered under Section 75 as I live in Spain?

It would be a great relief if I am.

There was a court ruling (House of Lords, I think) that held that purchases made overseas ARE covered by s75 as if they are made in the UK. So assuming the deposit is over £100 and the main cardholder is contracting to buy the car then should be no problem.

I don't think it matters that you live in Spain (rather than being someone who lives in the UK makes a trip to Spain) except as follows: If it is a condition (rather than a mere term) of your contract with your CC that you are UK resident and they do not know that you aren't, then perhaps they could wriggle out. Else I think they are on the hook for this.

I should add... I HOPE you got a receipt for the cash if you are hoping to hold the CC liable for this element!

thanks - I have the receipts for the credit card and the cash. Also the CC company know I am in Spain as they send my statements here with no problem.
