Losing my right to share of profit when we sell?

Hi
Apolgies if this is on the wrong board -
I need some advice if anyone knows the answer please?
My ex and I are separated and still living together because we have a joint mortgage, but due to mortgage terms we can’t sell our house now or else we’d have a £9000 penalty to pay if we end early.
I’m thinking of moving out, and he’ll stay put and get someone else to move in to help him with mortgage payments until we can sell the house next March
Are there any legal requirements that will cause problems with me getting 50% of the profit when we sell next year because I’ve not been contributing towards mortgage payments?
I’d just like to cover my back as I have no savings and don’t want to somehow lose out on getting anything when we sell the house eventually
Any advice appreciated thanks

No. You either co-own the property or you don't. What might be a matter of discussion is what might happen if a lodger can't be found to contribute towards your share of the mortgage payments. But that's all down to mutual agreement once selling it is on the cards.0
